BIG 3 ENGINES LLC  Terms and Conditions

All purchases are final. Your warranty will be reflected in this invoice. If no warranty is described you will receive an automatic 30 day warranty on all recycled parts and a 1 year warranty on all re-manufactured and performance parts. The warranty is not transferable and is limited to 100k miles in all cases. Performance parts that are used for racing whether professional or otherwise(i.e. Street racing, dyno tuning, drag strip, circle track, dirt track, etc.) will be void of warranty and cannot be covered for any length of time due to the nature of mechanical parts under extreme conditions. Service contracts are available by request for racing engines and racing transmissions that will include a periodic tear-down and refresh. You will be required in all cases to perform the maintenance schedule recommended by Big 3 in order to maintain your warranty. If we fail to provide the maintenance schedule with your invoice it is your responsibility to contact us and receive your maintenance schedule, failure to receive the schedule does not constitute a reason to not follow said schedule from day 1. High performance units will require periodic tear down and refresh as this is the nature of mechanical parts that are used for extreme conditions. If you have purchased a re-manufactured unit you must perform all manufacturer recommended maintenance on time as outlined by the manufacturer(i.e. Fiat Chrysler, Chevrolet, Ford as listed in the vehicle manual). It is your responsibility to provide record of these services having been performed by an ASE certified shop in order to maintain your warranty. Your engine and/or transmission assembly are equipped with internal and/or external heat tabs. If the heat tab is damaged, removed, melted, or tampered with your warranty is automatically voided due to misuse. It is your responsibility to maintain gauges in your vehicle that monitor the temperature of your engine or transmission assembly to prevent overheat conditions. It is your responsibility to equip your vehicle, including carbureted vehicles and fuel injected vehicles of all types, with a device to prevent over revving the engine or transmission assembly. Engines or transmissions that have been introduced to an rpm range beyond the manufacturer recommended range will be void of warranty in all cases. Leaks can occur as with all things mechanical. It is your responsibility to repair any leaks that occur and these types of maintenance are not covered under your warranty. Engine or transmission assemblies in which you have failed to keep fluids full and in good condition of the proper grade and brand referenced by Big 3, and changed at the interval recommended by Big 3, will be void of warranty. In all cases an engine or transmission that has been placed into service for a particular use and is then repurposed will be void of warranty automatically. Your engine and/or transmission assembly including other parts such as transfer cases and ecm/pcm modules must be installed and inspected by ASE certified technicians at a certified shop or dealer Only. No warranty for the installation cost, labor or otherwise will be given. Your warranty is limited to the repair, replacement, or refund at our discretion for the assembly or unit purchased here only and the installation, shipping and required parts for installation into the vehicle or boat, etc. will be entirely covered by the purchaser and not Big 3. By conducting a transaction or purchase with Big 3 in any capacity including but not limited to Online and In-person Sales of any form will serve as an automatic agreement to these terms and conditions.

PRIOR TO STARTING WORK ON THE LONG BLOCK, READ THE OIL RECOMMENDATION, AERA SUGGESTED INSTALLATION PROCEDURES AND INSTRUCTIONS FOR GASOLINE ENGINES, AND AERA BREAK-IN PROCEDURES FOR REMANUFACTURED ENGINES. AS A MATERIAL PART OF THE CONSIDERATION FOR THIS AGREEMENT, SELLER AND PURCHASER AGREE, ANY STATEMENTS MADE BY THE SELLER WERE MERELY THE SELLER'S OPINION AND THE BUYER IS NOT RELYING UPON THEM IN MAKING A DECISION TO PURCHASE. Force Majeure. Big 3 shall not be liable in any way for failure or delay in carrying out its obligations where the carrying out of such obligations are prevented, hindered, delayed or rendered uneconomic by any cause whatsoever beyond Big 3's control and in particular, but without prejudice to the generality of the foregoing, by (a) act of God, war, riot, civil commotion, (b) Government controls, restrictions or prohibitions or any other Government act or omission whether local, state or national, (c) declaration of a local, state or national emergency, (d) catastrophic event such as a pandemic, fire, flood, tornado or other extreme climatic conditions, (e) sabotage, accident, breakdown of plant or machinery, (f) strikes or lock-outs, trade disputes or labor disturbance or (g) difficulty or increased expense in obtaining labor, materials or transportation or other circumstances affecting the completion of Customer’s order by the normal means. IN NO EVENT WILL Big 3 BE RESPONSIBLE OR LIABLE TO BUYER FOR ANY INCIDENTAL, INDIRECT OR CONSEQUENTIAL DAMAGES.
